6 Q. (BY MR. GODWIN) Sir, I'm going to hand you
7 what's been marked as Exhibit 22. This shows -- this is
8 a Vanity Fair article dated May, 2005.
9 A. Yes, it is.
10 Q. And it has you and others on the last two
11 pages --
12 A. Yes, it does.
13 Q. -- on a boat --
14 A. Nice picture, isn't it?
15 Q. -- known as -- well, I was going to say you
16 have aged a lot since this picture, but -- certainly
17 your hair has got longer. Let's put it that way.
*********
149
23 Q. Remember we still have a trial. There will be
24 some more of it come up then, but no reason to go over
25 it all now. Can't have it all. You'll have cut your
150
1 hair by then, you know.
2 A. You have a thing about my longer hair, don't
3 you? Are you jealous or what?
4 (Off-the-record discussion.)
5 (Exhibit No. 25 marked.)
6 THE WITNESS: Well, you'd probably look
7 better if you shaved it. Anyway, go ahead.
8 MR. GODWIN: I know you would be. I know
9 you would look better if you shaved yours.
10 THE WITNESS: Do you really think so?
11 MR. GODWIN: Yeah, I really do.
12 THE WITNESS: That's amazing. Your wife
13 doesn't think so.
14 MR. STEVE SUMNER: Let's take a
15 deposition here.
16 MR. GODWIN: I understand. My wife
17 wouldn't waste her time with you, and I resent you
18 making that suggestion.
19 THE WITNESS: Well, you keep with the
20 insults to me, it's going to get even worse for you.
21 MR. GODWIN: I understand. What did you
22 say?
23 THE WITNESS: I said it's going to get
24 even worse for you if you complete -- continue with the
25 insults towards me. I'll answer your questions, but
151
1 you're not going to insult me.
2 MR. GODWIN: I'm doing my depo.
3 MR. STEVE SUMNER: Listen. Do the
4 deposition.
5 MR. GODWIN: I'm asking my questions.
6 THE WITNESS: Then ask them, and let's
7 refrain from any more comments about my hair. Do you
8 understand me?
9 MR. GODWIN: Don't threaten me again.
10 THE WITNESS: I'm going to threaten you
11 if --
12 MR. GODWIN: Don't threaten me again.
13 THE WITNESS: Say something else about my
14 hair.
15 MR. GODWIN: Don't threaten me again.
16 THE WITNESS: Say something else about my
17 hair.
18 MR. STEVE SUMNER: Let's take a
19 deposition today.
20 MR. GODWIN: Okay.
21 THE WITNESS: Come on, old man. Say
22 something about my hair.
23 Q. (BY MR. GODWIN) Sir, you have been handed
24 Exhibit Number 25.
25 A. I have got it.
***********
214
20 A. And I would take issue with the fact that --
21 Bob and Myrna are gentleman and lady enough not to throw
22 personal insults like you did.
23 Q. I just said I didn't like your hair.
24 A. So if Bob or Myrna had thrown a personal
25 insult -- it's a personal insult.
215
1 Q. You were the one said what you did about my
2 wife.
3 MR. PACE: Stop it, or we will break it
4 down right now and take a break if we need to. Don't
5 argue with the witness.
6 A. Anyway, I don't remember --
7 MR. GODWIN: Let me just say this. Steve
8 is the one defending the deposition. I'm not arguing
9 with the witness, and I don't appreciate you --
10 MR. STEVE SUMNER: We are way afield.
11 We're way afield.
12 MR. GODWIN: -- chiming in, Dave, and
13 start giving me instructions on what we are or not going
14 to do.
15 MR. PACE: I'm an attorney. I represent
16 this client. I'm an officer of the Court. When I see
17 an another attorney start arguing with a witness, I'm
18 going to speak up, and I'm going to say it's going to
19 stop. And it's going to stop.
20 MR. GODWIN: Are you through?
21 MR. PACE: Yes.
22 MR. GODWIN: Okay.
